We’re here to sell you chrome charms and pixel-heart nostalgia, not to hoard your personal data. This page explains in plain English what we collect, why we collect it, who sees it, and what you can do about it. No maze, no fine-print traps.
Who we are
90WEAR is the brand and online store operated by V3 DIGITAL MARKETING S.A.C., RUC 20613695452, a company registered in Peru. V3 DIGITAL MARKETING S.A.C. owns and operates ninetywear.com and is the business responsible for (the data controller of) the personal information described in this policy.
This policy covers ninetywear.com and any order placed through it. It does not cover other websites we may link to; those sites have their own privacy policies. We currently ship to the United States only, and all prices are in US Dollars (USD).
Information you give us
You share information with us directly when you shop or get in touch. That typically includes:
- Contact details such as your name and email address.
- Shipping and billing addresses, including city, state, and ZIP code, and a phone number if you provide one for delivery.
- Order details such as the items you bought, order value, order number, discount codes used, and order status.
- Messages you send us, including support emails, return requests, and any photos or details you attach to them.
- Marketing preferences, such as whether you opted in to email updates.
- Account information, if you create an account, including your login email and saved addresses.
You can browse the shop without giving us any of this. We only ask for what an order actually needs.
Information we collect automatically
When you visit ninetywear.com, some information is collected automatically by our website and the tools that keep it running:
- Device and browser information, such as browser type, operating system, screen size, and language.
- IP address, which also gives an approximate location (city or region level). We do not collect precise GPS location.
- Usage data, such as pages viewed, products viewed, referring website, and how long you spent on a page.
- Email engagement, such as whether one of our emails was opened or a link inside it was clicked, where your email app allows that to be measured.
- Cookies and similar technologies, described in the cookies section below.
Payment information
Payments are handled by a third-party payment processor. When you pay, your card details go directly to that processor over an encrypted connection. We never receive or store full card numbers, and we never see your card security code. What reaches us is limited order-level information, which may include the card brand, the last digits of the card, the billing name and address, and whether the payment succeeded or failed.
The payment processor handles your payment data under its own privacy policy and its obligations as a payment provider.
How we use your information
We use personal information for the following purposes, and nothing sneakier:
- Fulfilling your order. Processing payment, packing your items, arranging delivery, and sending order confirmations and shipping notifications.
- Customer support. Answering your questions and handling returns and faulty-item claims. See Returns for how that process works.
- Email updates you asked for. If you opted in, we send new drops, restocks, and occasional offers. You can unsubscribe at any time.
- Fraud prevention and security. Verifying orders, spotting suspicious activity, preventing chargebacks and abuse, and protecting the store.
- Improving the store. Understanding which pages and products people actually use so we can fix what’s broken and build what’s wanted.
- Legal and accounting obligations. Keeping sales and tax records and responding to lawful requests.
We do not make automated decisions about you that produce legal or similarly significant effects. Fraud-screening tools may flag an order for review, but a person decides what happens next.
Cookies and tracking
Cookies are small files stored by your browser. We use two main kinds:
- Essential cookies. These make the store work: keeping your cart contents, remembering your session, keeping you signed in, and supporting checkout and security. The site cannot function properly without them.
- Analytics cookies. These help us understand traffic and behavior in aggregate, such as which pages are visited and where visitors drop off. We use this to improve the store, not to build a personal profile of you.
How to control cookies. Every major browser lets you block or delete cookies in its settings, and most let you block third-party cookies specifically. You can also browse in a private or incognito window. Blocking essential cookies may break the cart and checkout. If we display a cookie banner or preference control, you can change your analytics choice there at any time.
Some browsers and extensions send a Do Not Track or Global Privacy Control signal. Where we are required by law to treat such a signal as an opt-out request, we do.
How we share information
We share personal information only where it is needed to run the store, and only with parties that are bound to protect it:
- Payment processor. To take payment, verify it, and handle refunds and chargebacks.
- Shipping carriers and fulfillment partners. To pick, pack, and deliver your order, and to provide tracking. They receive your name, delivery address, and contact details for delivery purposes. See Shipping for details on how delivery works.
- Service providers under contract. Website hosting, email delivery, customer support tooling, analytics, and fraud prevention. They may only process your information on our instructions and for the purpose we hired them for.
- Legal requirements. We may disclose information where we are legally required to do so, to comply with a valid legal process, to enforce our Terms of Service, or to protect the rights, safety, and property of our customers, our business, or the public.
- Business transfers. If the business is ever sold, merged, or reorganized, customer information may transfer as part of that transaction. We will say so in this policy if it happens.
We do not sell your personal information. We do not rent it, trade it, or hand it to data brokers, and we have not sold or shared personal information in the preceding 12 months. We also do not share it for cross-context behavioral advertising. If we ever add tools that would change that, we will update this policy first and post a clear “Do Not Sell or Share My Personal Information” link before those tools go live.
Your choices
- Marketing emails. Click the unsubscribe link at the bottom of any marketing email, or email us at support@ninetywear.com. We will still send transactional messages about orders you placed, such as confirmations and shipping updates.
- Cookies. Manage or block them through your browser settings, as described above.
- Access, correction, and deletion. You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email support@ninetywear.com and we will help. We may need to keep certain records, such as completed order and tax records, where the law requires it.
- Account details. If you have an account, you can update your contact and address details by signing in.
California privacy rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you specific rights over your personal information.
Categories of personal information we collect
- Identifiers, such as name, email address, postal address, phone number, and IP address.
- Customer records information, such as billing and shipping address and limited payment details (we never hold full card numbers).
- Commercial information, such as products purchased or viewed and order history.
- Internet or network activity, such as browsing activity on our site and interactions with our emails.
- Approximate location inferred from your IP address.
We collect these from you directly, automatically from your device, and from our service providers such as the payment processor and shipping carriers. We use them for the purposes listed in How we use your information above, and we keep them for the periods described in How long we keep your information below. Apart from account log-in credentials, which exist only so you can reach your own account, we do not collect sensitive personal information as California law defines it, and we do not use personal information to infer characteristics about you. We do not knowingly collect personal information from anyone under 16.
Your California rights
- Right to know. Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclosed it to.
- Right to delete. Request deletion of personal information we collected from you, subject to legal exceptions such as completing a transaction, security, and record-keeping required by law.
- Right to correct. Ask us to fix inaccurate personal information we hold about you.
- Right to opt out of sale or sharing. We do not sell or share personal information as those terms are defined by California law, so there is nothing to opt out of today. If that ever changes, we will post a clear opt-out link and update this policy.
- Right to limit use of sensitive personal information. We do not use or disclose sensitive personal information for purposes that trigger this right.
- Right to non-discrimination. We will never deny you products, charge you a different price, or give you a lower level of service because you exercised a privacy right.
Other US state privacy rights
If you live in another US state with a comprehensive consumer privacy law, you generally have similar rights: to confirm whether we process your personal data, to get a copy of it, to correct it, to delete it, and to opt out of targeted advertising, sale, or profiling. Use the contact details below and tell us which state you live in. If we decline a request, you can appeal by replying to our response, and we will explain the outcome of that appeal.
How to exercise your rights
Email support@ninetywear.com with the subject line Privacy Request, and tell us which right you want to exercise. To protect your information, we will ask you to verify your identity, usually by confirming details we already hold, such as the email address and order number associated with a purchase. We will not use that information for anything other than verifying your request.
We aim to confirm receipt promptly and to respond within the time frame the law allows, generally 45 days, with an extension where the law permits it and we notify you. An authorized agent may submit a request on your behalf with written permission that we can verify.
Children’s privacy
Our store is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. We also do not sell or share the personal information of anyone under 16. If you are a parent or guardian and believe your child has given us personal information, email support@ninetywear.com and we will delete it.
How long we keep your information
We keep personal information only as long as we need it for the purpose it was collected for, and then delete it or make it anonymous:
- Order and transaction records are kept for as long as required by applicable tax, accounting, and commercial record-keeping law, and to handle any later dispute, return, or chargeback.
- Support conversations are kept while your case is open and for a reasonable period afterward, so we have context if you write back.
- Marketing contact details are kept until you unsubscribe or ask us to delete them.
- Analytics data is kept in aggregated or de-identified form where possible.
How we protect your information
We use reasonable technical and organizational measures to protect personal information, including encrypted connections (HTTPS) across the site, restricted access to order data on a need-to-know basis, and a payment setup where card details go straight to the payment processor and never sit on our systems.
Being honest about this: no website, server, or method of transmission over the internet is 100% secure, and we cannot guarantee absolute security. If we ever become aware of a breach affecting your personal information, we will notify you and the relevant authorities as required by law.
Where your information is processed
V3 DIGITAL MARKETING S.A.C. is based in Peru. Your personal information may be processed and stored in Peru, in the United States, and in other countries where our service providers operate. Privacy laws in those countries may differ from the laws of your home state.
By placing an order or contacting us, you understand that your information may be transferred and processed in this way. Wherever it is processed, we require our service providers to handle it under contract, for our stated purposes only, and with appropriate safeguards.
Changes to this policy
We may update this policy as the store grows or as the law changes. When we do, we will revise the “Last updated” date at the top of this page. If a change materially affects how we use your personal information, we will make that clear, for example with a notice on the site or an email to subscribers. Continuing to use ninetywear.com after an update means you accept the revised policy.
